TERMS AND CONDITIONS
Definitions Application
- All services provided to our Clients are subject to these standard terms and conditions of trade.
- By registering as a Client, you are also registering on behalf of any business or company you own, control, or represent and which you nominate as part of your registration. By registering, you agree to be bound by these Terms, which constitute an agreement between Women’s Business Collective Pty Ltd ACN 616 815 171 (Women’s Business Collective) and you.
- In these terms and conditions – “the Company” shall mean Women’s Business Collective Pty Ltd and “the Client” shall mean a client of the Company or an applicant for credit from the Company.
DEFINITIONS
Account means the Women’s Business Collective account relating to a Client.
Confidential Information means confidential information by a party and includes information whether verbal, written or in some other form, including electronic form relating
a. the Mission and the Tour;
b. the Terms and Conditions;
c. any information shared by us, including but not limited to, business strategies, financial data, and other information.
Mission means the international tour collaboration and connection provided by Women’s Business Collective in accordance with the Mission Objectives.
Terms means these Terms and Conditions.
We, us, or our means the Women’s Business Collective.
You or your means the Client.
MISSION OBJECTIVES
4. The objectives of the Mission include but are not limited to:
a. fostering international collaboration and connection;
b. providing a platform for women’s voices;
c. promoting female entrepreneurship; and
d. exploring opportunities for female founders in global markets.
ENQUIRIES
5. You can book our Services via our website
6. Once our Services have been successfully booked, you will receive a confirmation email from us.
7. Any Services provided by us are subject to these Terms.
OUR RESPONSIBILITIES
8. We agree to coordinate events and activities in accordance with the Missions Objectives, where reasonable to do so.
9. We reserve the right to change or amend any Mission tour schedule provided to you.
PARTICIPANT RESPONSIBILITIES
10. You agree to actively participate in all scheduled activities, including meetings, workshops, networking events, and site visits.
11. If you are unable to attend a scheduled activity, you must advise us immediately.
12. You agree to adequately prepare for the Mission by researching target markets, identifying potential partners, and developing relevant material to present during meetings.
13. You are responsible in creating opportunities and developing outcomes.
14. It is your responsibility to conduct your own research in order to appropriately participate in all scheduled activities.
15. It is your responsibility to conduct 1:1 meetings with your contacts.
16. It is your responsibility to add an additional date either before or after the Mission tour if needed to ensure ample time to co-ordinate meetings with our network contacts.
17. If you are seeking a specific opportunity or introduction, it is your responsibility to notify us ahead of the Mission tour. Once the introduction has been made, it is your responsibility to arrange a meeting.
18. If you intend to bring family members to the Mission, you acknowledge and agree that it is your responsibility to cover all the costs, including but not limited to, accommodation, insurance, food, and travel fees. We will not cover any costs for family members.
PARTICIPANT EXPENSES
19. You acknowledge and agree that you are responsible to for all additional expenses relating to your participation in the Mission except for the expenses outlined in clause 8 of these Terms.
20. You agree to pay for the following:
a. international return flights
b. travel insurance;
c. train, metro or bus tickets where applicable
d. lunch and dinner each day (excluding the welcome dinner, and any official tour dinners or lunches);
e. Uber and/or taxi costs where applicable
f. transfers to and from the airport;
g. visa applications where applicable
21. The expenses listed in clause 22 is not an exhaustive list. You must have sufficient means to pay for any other travel related costs which may arise.
PRICES
22. We reserve the right to vary the prices from time to time by first providing written notice to you.
PAYMENT AND DEPOSITS
23. You will be solely responsible for all payments owed pursuant to any Invoice. Any payment of an invoice issued to you must be made in accordance with these Terms and Conditions.
24. Invoices must be paid within 7 days.
25. You have the choice to pay the entire amount of the Mission Tour, or pay via weekly, fortnightly or monthly instalments. All payments made are non-refundable.
26. If payments are made via weekly, fortnightly or monthly instalments, the entirety of the costs for the Mission Tour must be paid two (2) weeks before the Mission Tour begins.
27. Payments must be made by bank deposit, credit card or cash. Any final payments made using a credit card will incur a 2.5% fee; Amex will incur a 3.5% fee.
OVERDUE PAYMENTS
28. Payments of invoices must be made before the due date, unless agreed otherwise by Women’s Business Collective.
29. If you fail to make a payment by the due date, you pay 10% interest per annum, the penalty interest rate permitted by law.
CANCELLATION AND/OR RESCHEDULING MISSION TOUR
30. If you cancel the Mission tour entirely, we shall be entitled to retain any monies paid by you to us.
31. You will not have the opportunity to reschedule the Mission Tour. If you are no longer able to participate in the Mission Tour, you will not be entitled to a refund.
DISCLAIMER
32. We make no guarantees regarding potential outcomes of the Mission tour, including but not limited to, securing partnerships, investments, business opportunities or contracts.
33. For clarity, we cannot guarantee business or financial outcomes. It is not our responsibility to guarantee this.
34. We cannot guarantee success of any introduction opportunity.
35. We cannot guarantee introductions with individuals who we do not have established relationships with.
INDEMNITY
36. You agree to indemnify us (including our officers, employees, shareholders, agents, affiliates, associated entities or other representatives) from and against all actions, claims, suits, demands, damages, liabilities, costs or expenses (whether in tort or in contract including and without limitation, negligence) arising out of or in any way connected to your breach of the Terms.
RIGHT OF TERMINATION
37. Women’s Business Collective reserves the right to, at any time, terminate this Agreement, if you breach these Terms, or engage in any disruptive behaviour during the Tour. If this occurs, any fees paid to us will be non-refundable.
38. You must provide written notice if you terminate this Agreement. Any fees paid by you will be non-refundable.
DISPUTE RESOLUTION
39. If there is a dispute between you and the Women’s Business Collective, you agree to notify us promptly of the dispute and resolve the dispute in good faith. If you and Women’s Business Collective are unable to resolve the dispute, then either party may submit the dispute for non-binding impartial mediation. If the dispute is not resolved by mediation, either party may pursue any remedy available to it under the laws of Queensland, Australia.
CONFIDENTIALITY
40. Any order made under these Terms and Conditions is strictly confidential.
41. A party to these Terms and Conditions must not disclose to any third party, without prior written consent of the other
party, any Confidential Information provided from the other or during the Tour.
42. For the sake of clarity, any Confidential Information that is shared to you during the Tour must remain confidential.
ENTIRE AGREEMENT
43. These Terms and Conditions are the entire agreement between the Women’s Business Collective and you, and will replace any previous discussions or agreements relating to the content of these Terms.
GOVERNING LAW
44. The laws of Queensland govern these Terms.
SEVERABILITY
45. If any clause or subclause in these Terms and Conditions are unenforceable, illegal, or void, or makes these Terms and Conditions or any part of it unenforceable, illegal or void, then that clause or subclause is severed, and the rest of the Terms and Conditions remain in force.
